1. The design, organisation and implementation of the activities is the responsibility of eXperienciescostabrava.

The payment of the reservation implies the acceptance of the General Conditions.

 

2. Prices 

2.1 The prices for each activity will be those shown on the website www.experienciescostabrava.com

2.2 The prices include VAT and all that is exposed in the section ‘includes’ of each activity sheet.

2.3 The implementation of Programmed Activities is subject to completing the minimum number of places indicated on each activity sheet. In the event of not completing these minimum places, the price set out for this activity will be applicable according to the number of people attending. The participant may choose to attend by paying the price that corresponds to the number of attendees or receive a voucher for the amount paid that can be used in any other activity.

2.4 The prices do not include any costs necessary to meet visa or other entry requirements for certain countries (medical insurance, special accident insurance, etc.).

 

3. Booking, payment and cancellations of programmed activities 

3.1 Reservations will be made in strict order of payment of the amount stipulated for each activity as a deposit for the reservation.

3.2 If the booking is made by telephone, the availability of places will be confirmed at the time and you will have a maximum period of 24 hours to make the deposit of the reservation, for the amount indicated in each information sheet in the account of BANCO SABADEL / BIZUM, indicating the activity and name. 

3.3 In case of making the booking online, the availability of the place is immediate and you will have to follow the instructions received in the contact email or WatsApp.

3.4 The rest of the payment will be made before the deadline date set in each activity form, in the case of activities that are not paid in full because it has been agreed at a particular level.

 

 

3.5 In the event of cancellation or modification of the booking by the user, the following penalties will apply:
 

More than one month before the start of the programme: 100% refund.

From one month to 15 days before: 50% refund. 

From 14 days to 7 days before: 25% refund.

Less than 7 days before: no refund.

Under no circumstances will payments and deposits be returned.

Under no circumstances will any expenses incurred by third parties and related to the activity be refunded.

 


3.6 If there is a waiting list on the deadline for the activity, the places reserved and not paid in full will be covered by those included on the waiting list. 

3.7 Minors must provide parental consent on the day of the activity as well as a photocopy of the parent's or guardian's ID card.

3.8 In the event that the cancellation or modification by the client affects the price of the other participants with an increase in price, this increase will be deducted from the amount to which the client is entitled to a refund, according to section 3.5. 

 

4. Booking and payment of à la carte activities (all international activities in addition to those specified are considered à la carte).

4.1 Payment of the reservation, the amount of which will be determined for each particular activity, will consist of payment into the BANCO SABADELL account or by bank card payment at the Virtual POS, indicating the name of the person or company contracting the activity. There will be no refund of the amount paid to reserve the activity in the event of cancellation by the client.

4.2 The name, surname, ID number and required details of the participants (clothing sizes, shoe size, etc.) will then be notified via the online customer file.

4.3 In the event of cancellation by the user, section 4.1 will be applied, as well as the penalty set out in section 3.5, for the rest of the amount paid for the activity.

4.4 Minors must provide parental consent on the day of the activity as well as a photocopy of the ID of the parent or guardian.

5. Vouchers and gift cards

5.1 Participants who wish to pay for any of the activities with vouchers or gift cards will have to make this known at the time of booking, being included in the activity the services specified in the vouchers themselves and not those of the website.

5.2 Regal Voucher is a means of payment by means of which the beneficiary can enjoy any of the activities offered on our website, subject to availability. 
 

The commercial value of the voucher is limited by the price printed on the card. The values available at the moment are: 35€, 45€ and 100€.

The value of the xex gift is not refundable in any case.

The gift voucher can only be used by the bearer.

The gift voucher is valid for 18 months from the date of purchase.

In order to cash the gift voucher, you must provide us with your name and ticket or invoice number, so that we can prevent counterfeiting of the voucher.

The non-use of the gift voucher by the beneficiary during its validity does not cause any financial obligation to eXeperiències Costa Brava, a fact that is understood and accepted by the purchaser and/or beneficiary of the Gift Voucher.

 

 

  • Acquisition method: The gift voucher can be purchased on our website or directly via WhatsApp at +34 627972400.

  • Accumulation: One or more Good Gifts can be accumulated to carry out the activities, provided that the veracity of each of them is verified.

  • Credit balances: Credit balances are not handled in the event that the purchase of a product is for a lower price than the economic value of the Good Gift. In this case, the beneficiary has to add another activity in order to complete the value of the Good-Gift and, if necessary, pay the excess of the total sum of the selected products and the Good-Gift.

  • Purchase for a higher value: In case the beneficiary of the Good-Gift wants to buy a product that has a higher price than the economic value of the Good-Gift, he/she can do so by adding the missing amount.

  • Security of the Good Gift. It is the obligation of the beneficiary of the Good Gift and the purchaser of the same not to share the information of the Good Gift, since this could be used fraudulently by third parties. In this regard, the beneficiary of the Good Gift and the acquirer understand and accept that it is their sole responsibility to share the information of the Good Gift with third parties, whatever the means used to share this information. In these cases, eXperiencies Costa Brava is exempt from liability.

5.3 If the activity cannot be carried out for reasons beyond the company's control (weather, lack of snow, etc.) a similar alternative activity will be carried out. In the specific case of snowshoeing, via ferrata or climbing, they will be replaced by hiking.

 

 

6. Insurance
6.1 All participants have an accident insurance that covers the activity/s to be carried out, without prejudice to the fact that certain activities may require additional insurance.
6.2 MIGUEL ANGEL LOPEZ GALAN eXperiencies Costa Brava has accident / RC insurance for the participants of all our activities, which are covered by PREVIS insurance.
 

7. Alteration of the routes. 
7.1 Mountain activities are subject to possible changes due to weather conditions and the physical and mental characteristics of the participants. The itineraries may be modified and even partially or totally suspended if circumstances make it advisable, at the discretion of the guide.
7.2 In order to ensure the smooth running of the activity, the guide responsible for the activity may adapt it according to the weather forecast plan of the AEMET (Agencia Estatal de Meteorología), or other international, national or local meteorological services.
7.3 However, in the event that the activity has started and has to be suspended for the reasons indicated in the section No reimbursement will be made, given the unpredictability of these external factors. For this purpose, the activities start after presenting themselves to the responsible guide at the meeting point of the activity.

 

8. Responsibilities of the guide

8.1 All eXperiencescostabrava activities are carried out by qualified guides.
8.2 The guide is the person in charge of the activity, making the most appropriate decisions for the smooth running of the activity, taking into account weather conditions and the physical and mental condition of the participants.

8.3 Participants undertake to comply with the guide's instructions. If these instructions are not followed, both MIGUEL ANGEL LOPEZ GALAN eXperiencies Costa Brava and the guide decline all responsibility for any consequences that may arise, giving rise, if necessary, to the expulsion of the participant or even the suspension of the activity, with the loss of all rights.

 

9. Right of admission

9.1 MIGUEL ANGEL LOPEZ GALAN eXperiencies Costa Brava and, if applicable, the activity guide, reserve the right to refuse admission to any person who does not present the necessary psychophysical or technical conditions for carrying out the activity at the time prior to the start of the activity.

9.2 Likewise, any person who is not present at the beginning of the activity with the material specified in the section ‘Necessary material’ or indicated by e-mail or WhatsApp, will not be allowed to participate in the activity, always at the discretion of the guide.

9.3 The situations specified in sections 9.1 and 9.2 imply a loss of all rights by the participant and loss of the amount of the activity.

 

10. Punctuality and right to carry out the activity.

10.1 For the sake of attention and respect for the rest of the participants and the guides, there will be no wait after the start time.
There will be various notifications made by our staff before starting the activity (minimum 2 WhatsApp notifications and or phone call), so if the client does not answer, they will be considered not present and the activity will proceed to carry out the activity.

10.2 Punctuality: Clients must arrive at the sports activity at the specified start time 15 minutes in advance to be able to get equipped.
In case of delay, you will be expected a maximum of 10 minutes after the scheduled start time.
After this period, admission is not guaranteed.

10.3 Right to perform: If a client arrives later than the 10 minutes allowed, their right to perform the activity will decline.
No refunds will be given or alternatives offered.
